PUBLIC OFFER

  1. GENERAL PROVISIONS

1.1. This public agreement (hereinafter referred to as the “Offer” or the “Agreement”) is an official offer made by the retreat center Home of Ayahuasca, hereinafter referred to as the “Contractor,” to provide services specified in clause 3.1 of this Agreement to individuals, hereinafter referred to as the “Client.”

1.2. This Agreement is considered concluded from the moment of its acceptance by the Client. Acceptance, for the purposes of this Agreement, is recognized as the Client’s preliminary payment for the Contractor’s services.

1.3. The Contractor and the Client provide mutual guarantees of their legal and legal capacity necessary for the conclusion and execution of this Agreement for the Provision of Services for Compensation.

  1. TERMS AND DEFINITIONS

2.1. For the purposes of this Offer, the following terms are used with the following meanings:

  • Offer: This public contract for the provision of services.
  • Internet resource: The website https://www.home-of-ayahuasca.com/ , including all related “subdomains” used by the Contractor.
  • Services: The Contractor’s services for organizing and conducting the Retreat in accordance with the terms of the Offer.
  • Retreat: A complex event organized by the Contractor under this Agreement, including accommodation, meals, transfer, healing and/or shamanic plants, as well as other activities provided for by an individual retreat program agreed with the Client, taking into account the information provided by the Client.
  • Retreat Center: Separate houses on the territory of the retreat center, specially built by the Contractor, providing suitable housing for the duration of the retreat and for the activities specified in the retreat program.
  • Contractor: The retreat center Home of Ayahuasca, which provides services to the Client based on the terms set forth in this Agreement.
  • Client: An individual who accepts the Offer in accordance with the conditions stated within.
  1. SUBJECT OF THE CONTRACT

3.1. The subject of this Agreement is the organization and conduct of the Retreat by the Contractor (referred to as the “Services”). The place of service provision is the retreat center Home of Ayahuasca, located in the Loreto region, Peru. The program, time, duration, and cost of the Services are agreed upon through correspondence via e-mail, WhatsApp, Telegram, and other official channels of the Contractor after the Client fills out the Application Form on the page https://www.home-of-ayahuasca.com/contact-us/. This agreement does not include services for organizing the Client’s visa support or international flights to the country of the Retreat and back.

3.2. Accommodation conditions include a single equipped house, individual bath, and separate toilet. Meals provided are full board with self-cooking in the kitchen over an open fire. The transfer from Iquitos airport and back is included.

  1. PROCEDURE FOR CONCLUDING THE AGREEMENT. ACCEPTANCE.

4.1. The parties agree that acceptance (consent) for the conclusion of this Agreement is the Client’s preliminary payment for the Contractor’s services. The prepayment amount is 500 USD.

4.2. By accepting this offer, the Client agrees that in case of cancellation less than 14 days before the start of the Retreat, the prepayment is non-refundable, as well as accepts all the conditions set forth in this Agreement.

  1. PAYMENT PROCEDURE

5.1. The Client is required to make a preliminary payment of 500 US dollars in accordance with this Agreement, unless otherwise agreed upon with the Client. Payment should be made using the details specified in the correspondence from the official e-mail of the Contractor peru.mariri@gmail.com.

5.2. The final payment of the total cost of the Services under this Agreement is to be made by the Client prior to the start of the Retreat.

5.3. Upon the Client’s request, the payment can be made as a one-time payment, covering 100% of the total cost of the Services as specified in clause 3.1 of this Agreement.

5.4. In case of violation of the rules of being in the retreat center or the Client’s independent refusal from the Retreat, the cost of services paid to the Contractor is non-refundable.

5.5. The cost of the Contractor’s services is indicated in US dollars.

  1. RIGHTS AND OBLIGATIONS OF THE CLIENT

The Client has the right to:

6.1. Refuse the Service:

  • If the service is canceled more than 14 days before the start of the retreat, the advance payment will be refunded as per the conditions outlined in clause 6.4 within 5 (five) working days from the date of receipt of the written notification by the Contractor.
  • If the cancellation occurs less than 14 days before the start of the retreat, the advance payment is non-refundable.
  • If the Client refuses services after the start of the Retreat, the cost of paid services (100%) is non-refundable.

The Client undertakes to:

6.3. Review the information on preparing for the retreat and the rules of visiting the retreat center on the page https://a.homeofayahuasca.com//safety/preparation-and-rules

6.4. Familiarize themselves with the conditions for refunding funds in case of refusal to fulfill this Agreement.

6.5. Provide accurate information about their health condition, mental illnesses, addictions, and contraindications that may prevent them from using the services under this Agreement or pose risks to their life or health. This information should be provided in the questionnaire on the website at https://www.home-of-ayahuasca.com/contact-us/. By accepting this Offer, the Client agrees to the provisions of the Consent to participate in the Retreat.

6.6. Make payment for the Contractor’s services in the amount and manner prescribed in Chapter 5 of this Agreement.

6.7. Independently apply for a visa (if required) at the Visa Application Center or the Consulate of the relevant country in order to enter the country of the Retreat. Visa confirmation of residence in the country of the Retreat will be provided by the Contractor upon request from the Client.

6.8. Purchase medical insurance and air tickets at their own expense.

6.9. Arrive at the airport for check-in no later than 3 hours before the departure of the aircraft to undergo border and customs control.

6.10. Comply with the border and customs regulations of Peru, countries of departure and transit, and adhere to airline baggage rules.

6.11. Undergo a safety briefing and adhere to the rules of conduct in emergency situations. The Client is also expected to observe personal safety rules and emergency procedures during the Retreat.

6.12. Provide the Contractor with all necessary information for the provision of Services under this Agreement. The information provided must be accurate, reliable, and complete. The Client agrees to the processing of their personal data by the Contractor in accordance with the provisions specified in the Privacy policy.

  1. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR

The Contractor has the right to:

7.1. Refuse to provide the Service to the Client in case of violation of the settlement procedure (Chapter 5 of this Agreement).

7.2. Refuse to execute the Agreement if unreliable information is detected in the questionnaire, preventing the Retreat from being carried out as agreed.

The Contractor undertakes to:

7.3. Provide the Services agreed upon in this Agreement through e-mail correspondence and on the Internet resource.

7.4. Provide the Client with a safety briefing on precautions and rules of conduct in emergency situations.

7.5. Provide the Client with comprehensive information about the Services provided, including practices, the program of stay, accommodation and meals conditions, transfer services in the country of temporary residence, and other necessary additional services.

  1. RESPONSIBILITIES OF THE PARTIES

Client’s Responsibility:

8.1. The Client is responsible, including property responsibility, for any actions committed by them or decisions made during their stay in the country of the Retreat. The Client is also responsible for compliance with the laws of the host country. Ignorance of the laws or customs of the host country does not release the Client from liability in case of violation.

8.2. The Client guarantees the Contractor that they do not have any medical contraindications or diseases that may cause harm to their health during the provision of the Services. The Contractor shall not be liable for harm caused to the life and health of the Client as a result of providing false information about their health. If the Client has diseases that are obstacles to the provision of Services, the Client assumes all risks associated with their health.

Responsibility of the Contractor:

8.3. The Contractor undertakes to fulfill its obligations diligently in maintaining the Retreat (providing the Services) subject to the accuracy of the information provided by the Client, compliance with the rules of being in the retreat center’s territory, and full payment by the Client for the Services in a timely manner.

8.4. The Contractor shall not be liable if a foreign state refuses to issue entry visas to the Client along the Service route or for delays in the consideration of documents by the consulate of a foreign state.

8.5. The Contractor is not responsible for changes in the pricing policy of airlines, changes in fares for booked air tickets, flight delays and cancellations, changes in aircraft type, or the delivery and safety of the Client’s luggage.

8.6. The Contractor shall not be liable in case of improper provision of the Services due to inaccuracies, insufficiencies, or untimeliness of the information provided by the Client or due to other violations of the terms of this Agreement by the Client.

8.7. The Contractor is not responsible for the non-compliance of the Services provided with the Client’s expectations and/or for their subjective assessment. Such non-compliance or negative subjective assessment does not constitute grounds to consider the Services of poor quality or not in accordance with the agreed terms.

  1. OTHER PROVISIONS

9.1. This Agreement enters into force from the moment the Client accepts this Offer and remains valid until both Parties fully fulfill their obligations.

9.2. The pre-trial dispute settlement procedure is mandatory for the Parties.

9.3. All matters not regulated by this Agreement are governed by the current civil legislation of Peru.

9.4. The Parties acknowledge the legal force of electronic communication, including documents sent by e-mail, correspondence in WhatsApp, Telegram, and other official channels of the Contractor indicated on the website www.home-of-ayahuasca.com. Such electronic communication is considered equivalent to documents on paper signed with a handwritten signature. Each Party shall access e-mail using a password and undertakes to keep it confidential. Only the Parties and authorized persons have access to the respective e-mail addresses specified in the Agreement as the details of the Parties, which are considered the electronic signature of the respective Party.
